Welcome to Sportkini (“Company,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of the sportkini.com website (the “Site”), your purchase and use of our products, and your participation in any events we host or attend (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must discontinue use of our Services immediately.

1. ACCEPTANCE OF TERMS

By accessing or using our Site or purchasing our products (online or at events), you agree to these Terms and our Privacy Policy. If you do not agree with these Terms, please do not use our Site, attend our events, or purchase our products.

2. ELIGIBILITY

You must be at least 18 years old (or the age of majority in your jurisdiction) to make a purchase from us or use our Services. By using the Services, you represent and warrant that you meet this eligibility requirement.

3. INTELLECTUAL PROPERTY

All content on the Site, including text, images, graphics, logos, designs, button icons, photographs, and other files, is the exclusive property of Sportkini or its content suppliers and is protected by U.S. and international copyright laws. You agree not to reproduce, duplicate, copy, sell, or otherwise exploit any portion of the Site or our Services without express written permission from us.

4. PRODUCT AVAILABILITY

  • All products offered are subject to availability.
  • We reserve the right to discontinue or modify any product at any time without notice.
  • Because many of our products are limited edition, certain items may not be restocked once they sell out.

5. ORDERS AND BILLING

  • Order Acceptance: Once you place an order, we will send an email confirming receipt of your order. This confirmation does not guarantee acceptance of your order. We reserve the right to refuse or cancel any order for any reason at any time.
  • Payment: You agree to provide current, complete, and accurate purchase and account information for all purchases.
  • Billing Accuracy: We reserve the right to cancel any orders arising from inaccurate or fraudulent billing information.

6. RETURN AND EXCHANGE POLICY

We aim to ensure that you receive the right-fitting swimsuit the first time you purchase from us, whether online or at an event. Please read our Return and Exchange policy carefully before making any purchase.

6.1 Return Policy Overview

We have a 14-day return policy, which means you have 14 days after receiving your item to request a return or exchange.

  • To be eligible for a return, your item must be in the same condition that you received it: unworn or unused, with tags, and in its original packaging.
  • You must also provide the receipt or proof of purchase.

Items sent back to us without first requesting a return will not be accepted.

6.2 How to Initiate a Return

  1. Contact Us: To start a return or exchange, please email us at info@sportkini.com.
  2. Shipping Address: If your return is approved, you will need to ship the product(s) to:

  3. Event Purchases:
    • If you purchased an item at an event, no return shipping labels will be provided. It is your responsibility to ship the item back to us if you wish to return or exchange it.
    • If you are exchanging the item, we will cover the shipping cost of the new item sent back to you (see Section 6.4).

6.3 Damages and Issues

  • Inspection Upon Receipt: Please inspect your order upon receipt.
  • Report Damage or Wrong Item: If you find any damage, defect, or if you receive the wrong item, contact us immediately at info@sportkini.com so we can evaluate and correct the issue.

6.4 Exchanges

  • Fastest Method: The quickest way to ensure you get the product you want is to return the item you have and, once the return is accepted, make a separate purchase for the new item.
  • Shipping for Exchanges:
    • When exchanging an item, you must ship the original item back to us at your own cost (unless otherwise stated).
    • Once we receive the original item and approve the exchange, Sportkini will cover the shipping cost of sending the exchanged product back to you.

6.5 Non-Returnable Items

  • Sale Items or Gift Cards: We cannot accept returns on sale items or gift cards.

6.6 European Union 14-Day Cooling Off Period

  • If merchandise is shipped to the European Union, you have the right to cancel or return your order within 14 days, for any reason and without justification.
  • The same condition requirements apply: items must be unworn or unused, with tags, and in original packaging, along with proof of purchase.

6.7 Refunds

  • Processing Time: Once we’ve received and inspected your return, we will notify you of approval or rejection.
  • Approved Refunds: If approved, you’ll be automatically refunded on your original payment method within 10 business days.
  • Bank Processing: Please note it may take additional time for your bank or credit card company to process and post the refund.
  • Follow Up: If more than 15 business days have passed since we approved your return, contact us at info@sportkini.com.

7. EVENTS AND FITTINGS

  • We attend various events to offer on-site fittings.
  • We highly recommend you visit us at an event to get properly fitted and avoid the hassle and cost of multiple return shipments.
  • Items may be available at events that are not listed on our Site.

8. SHIPPING POLICY

  • Online Orders: Shipping costs and methods vary based on your location and the items ordered. Shipping costs will be calculated and displayed at checkout.
  • Event Purchases: As noted above, if you purchase at an event and later wish to return or exchange the product, you are responsible for shipping it back to us.
  • Exchanges: For exchanges, once we receive and approve the returned item, we will ship the new product to you at our expense.

9. DISCLAIMER OF WARRANTIES

Your use of the Site and purchase of products are at your sole risk. The Site and products are provided on an “AS IS” and “AS AVAILABLE” basis. We disclaim all warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose, unless explicitly stated otherwise in writing.

10. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Kandu Sport Company, its affiliates, officers, directors, employees, agents, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from or related to your use of the Services or purchase of any products.

11. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Kandu Sport Company and its affiliates, officers, directors, employees, agents, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms.

12. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any dispute arising from or related to these Terms shall be resolved in the state or federal courts located in Brevard County, Florida, and you consent to the exclusive jurisdiction of such courts.

13. MODIFICATIONS

We reserve the right to update or modify these Terms at any time. If we make material changes, we will notify you by updating the “Last Updated” date at the top of this document. By continuing to use our Services after such changes, you agree to the revised Terms.

14. SEVERABILITY

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed, and the remaining provisions shall remain in full force and effect.
